These Terms & Conditions (“Terms”) govern your use of cargotrailer.us and any purchase you make from Cargotrailer, a store operated by TARCHER LOWERY LLC (“we”, “us”, “our”). By using our website or placing an order, you agree to these Terms.

1. Eligibility

You must be at least 18 years old and able to enter into a binding contract to place an order. Our products are sold for delivery within the United States only.

2. Products and information

We make every effort to describe and photograph our trailers accurately. Specifications, colors and features may vary slightly from the images shown, and manufacturers may update designs over time. If a specification is critical to your use, please contact us to confirm it before ordering.

3. Prices and availability

All prices are in US dollars (USD). Prices and availability may change without notice. If a product is listed at an incorrect price because of an error, we will contact you before processing your order and let you choose to continue at the correct price or cancel for a full refund. We may limit quantities or decline an order at our discretion.

4. Orders

Your order is an offer to buy. We accept it when we confirm it and process payment. We may cancel an order if a product is unavailable, if there is a pricing error, or if we cannot verify payment or delivery details; in that case, you receive a full refund.

5. Payment

We accept the payment methods listed in our Payment Policy, including Afterpay. Payment is due at the time of purchase, or in installments if you use Afterpay under Afterpay’s own terms.

6. Shipping and delivery

Shipping is free on every order delivered within the United States, with a total delivery time of 4–10 business days. Delivery times are estimates and not guaranteed. Risk of loss passes to you on delivery. Full details are in our Shipping & Delivery policy.

7. Returns, refunds and warranty

You may return eligible trailers within 30 days of delivery in original, unused condition. Every trailer is covered by a 2-year warranty against manufacturing defects and faulty parts. Full terms are in our Refund & Return Policy.

8. Safe use, registration and compliance

You are responsible for using your trailer safely and lawfully, including:

• Making sure your tow vehicle, hitch and ball are rated for the trailer and its load.
• Not exceeding the trailer’s rated capacity.
• Securing loads properly and checking lights, tires, brakes, coupler and safety chains before every trip.
• Titling, registering and insuring the trailer as required by your state, and complying with all local towing laws.

9. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special or consequential damages arising from the use of our website or products, including damage caused by misuse, overloading, improper towing or unauthorized modifications. Our total liability for any claim relating to a product will not exceed the amount you paid for that product. Nothing in these Terms limits any rights you have under applicable consumer protection law.

10. Website use and intellectual property

All content on this website, including text, images, logos and design, belongs to Cargotrailer or its licensors and is protected by law. You may not copy, reproduce or use it for commercial purposes without our written permission. You agree not to misuse the website, interfere with its operation, or attempt to access it by unauthorized means.

11. Third-party services

Some services on our site are provided by third parties, such as payment processors, Afterpay and shipping carriers. Your use of those services is subject to their own terms and policies.

12. Governing law

These Terms are governed by the laws of the Commonwealth of Pennsylvania and applicable US federal law, without regard to conflict-of-law rules. Any dispute will be handled in the courts located in Pennsylvania, unless applicable law requires otherwise.

We may update these Terms from time to time. The version in effect when you place your order applies to that order. The “Last updated” date at the top shows when these Terms last changed.
